There’s no doubt that one of the many challenges that come with owning commercial real estate, especially in California, is having to deal with frivolous ADA lawsuits.

The good news is that progress is being made when it comes to combating drive-by ADA Lawsuits thanks to the ADA Education and Reform Act of 2017. Thanks in part to the lobbying efforts of CCIM (Certified Commercial Investment Members), new legislation to curb ADA lawsuits will be enacted by Congress.

This new legislation gives property owners the ability to first make necessary repairs to their properties before an ADA Lawsuit can move forward.

“There is now a whole industry made up of people who prey on small business owners and file unnecessary and abusive lawsuits,” Representative Ted Poe of Texas, who co-sponsored the bill, said after introducing the measure in 2017. “This bill will change that by requiring that the business owners have time to fix what is allegedly broken.

It’s the right place and the right time for H.R. 620, the ADA Education and Reform Act of 2017 to be passed. Countless business owners across the United States have lost millions over the years because they didn’t have the opportunity to first resolve potential ADA violations before lawsuits could move forward so there’s hope that the wave of frivolous ADA lawsuits in the United States is finally ending.

What Exactly Is the CCIM Organization and What Does It Mean to “Be” a CCIM?

CCIM Institute is commercial real estate’s most influential professional organization, with members closing $200 billion annually in commercial real estate deals. A Certified Commercial Investment Member (CCIM) is different than other real estate brokers because we’ve taken the time to complete advanced coursework and training to become masters of commercial investment real estate. As demonstrated by its legislative affairs department, the CCIM Institute’s dedication to commercial real estate spans far beyond its three foundational pillars: Education, Technology, and Networking.

The CCIM designation isn’t just another title to go with our business name. Being a CCIM means that we possess the skills and knowledge that you need to minimize risk, make informed decisions, and close more deals.

Working with a CCIM in Los Angeles, or anywhere, is a smart move to make because, we average 42% more transactions than an average broker specialist and we take the time to really understand the commercial real estate industry, including conducting an in-depth market analysis of the market so you can have total confidence in your investment.
