2020 Rental Laws – Learn More About the Newest Laws and How They Affect Landlords in California

2020 is here and with it comes major changes for California’s rental market because we have new laws that have taken effect that will change the rental market in this state.

For today’s blog post, we’re going to spotlight into the new 2020 rental laws and provide you with more information on how they affect landlords and tenants statewide.

AB 1482

Authored by Assemblyman David Chiu, AB 1482 is also known as the “tenant protection act” because it’s going to slow down rent increases statewide since landlords in most areas will only be able to raise the rent by 5% plus inflation.

AB 1482 only applies to properties that are 15 years of age, or older, so if an owner has a newer multifamily property that was built within the last 10 years, they are exempt.

This bill is expected to be in place until 2030 and it also offers a wide variety of tenant protections, including making it more difficult for owners to issue just cause or no-fault evictions.

Owners must also pay their tenant a rent waiver, or relocation assistance, if they are issued a no-fault eviction and it must be paid within 15 days after the tenant receives a notice of termination of their tenancy.

SB 329

Another bill that became law as of January 1st is Senate Bill 329. This bill prohibits landlords from discriminating against tenants who use Section 8 to pay all or some of their rent.

AB 110

This bill requires landlords to submit a 90-day notice, instead of a 60-day notice, to tenants before they increase the rent of a month-to-month tenant by more than 10 percent.

Besides these tenant protection bills, the good news for developers is that the State of California has created density bonuses and a variety of other incentives to increase multifamily construction across California.
